GENERAL TERMS AND CONDITIONS OF USE OF THE MÉDIACITÉ APPLICATION

1.    Purpose
The Médiacité application is developed by DPHI SRL, registered with the Crossroads Bank for Enterprises under number 0811.908.608, whose registered office is located at Rue Saivelette 87 at 4671 Blégny. The maintenance and hosting of the Médiacité application are also the responsibility of DPHI SRL.
The daily management of the Médiacité application is monitored by the management company of the Médiacité shopping centre, Gesmall, registered with the Crossroads Bank for Enterprises under number 0898.224.057, whose registered office is located at Rue de la Bonté 5 in 1000 Brussels. 
DPHI SRL and Gesmall are hereinafter referred to as “the managers".
The Médiacité application provides access to various information, offers, promotions and the loyalty program related to the Médiacité Shopping Liège shopping centre. 
2.    Acceptance of the general terms and conditions of use

-    The member acknowledges having read and accepted these general terms and conditions of use relating to the Médiacité application and its loyalty program. 
-    The member also acknowledges having read and accepted the Médiacité privacy policy, which can be viewed on the Médiacité website at www.mediacite.be/fr/politique-protection-vie-privee-mediacite.
-    The managers reserve the right to modify these general terms and conditions, which can be viewed on the Médiacité website at www.mediacite.be/cgu-application.

3.    Operation of the Médiacité application
The member must follow the procedure below for the proper use of the application:
a.    Connect to a WiFi network or a cellular network at the member’s own expense.
b.    Download the application to an IOS or Android smartphone.
c.    Open the application.
Without registration, the user can access general information about the shopping centre, such as the map, services, shops, etc.
The user also has the possibility of using the application's loyalty program by registering through one of the four methods below: 
i.    Registration through Google.
ii.    Registration through Facebook.
iii.    Registration through Apple Sign In (only on IOS).
iv.    Manual registration using the form available on the application.
According to the third process, the member is asked to enter the following personal data: email address, last name, first name. They will also be asked to enter a personal password in order to be able to log into the application. The password is encrypted. 

d.    To log in. 
The member has the option of using the application, which consists of three tabs: 
i.    Home tab.
This tab contains the functions of the loyalty program and presents the following information: 
    Loyalty points counter. 
    Avatar and personal data. 
    Token counter.
    Presentation of the merchant of the month offer.
    Possibility of using a promo code.
    Badges that are unlocked/unlockable based on their purchasing behaviour.
    The notifications tab.
    The actual status of the member. 
    The possibility of participating in contests.
-    
ii.    Receipt scanning tab.
This tab allows the user to collect loyalty points according to his purchases made by simply taking a photo of the receipt.  
It is also possible for the user to review the history of the saved receipts. 
iii.    Info tab.
This tab refers to the centre’s information: info & schedules, map, services, shops, restaurants, leisure activities, events, telephone, email address, Facebook page and Instagram account.

4.    Reserved rights
The managers reserve the right to modify or suspend the Médiacité application or any of its components. Under no circumstances may the member exercise any recourse whatsoever against the managers, for any reason whatsoever.
5.    Responsibility
This application does not contain any commitment on the part of the managers as to the exhaustive and up-to-date nature of the information, offers, promotions and loyalty program of the Médiacité shopping centre. The member expressly waives any recourse against the managers for all direct or indirect consequences regarding the temporary or definitive cessation of the application or any other dysfunction thereof.
It is up to the member to keep their information up to date by modifying their profile or sending their request to the email address info@mediacite.be, the managers can in no way be held responsible in the event of non-receipt of an offer by a member due to obsolete or incorrectly filled in information.
6.    Respect for privacy and personal data
The information collected as part of the Médiacité application qualifies in part as personal data and is subject to computer processing intended for the creation of a customer and prospect file for the sending of commercial information, as well as for analyses and statistics. Gesmall and the company Givenmine, registered with the Crossroads Bank for Enterprises under number BE 0744.638.712, whose registered office is located at 4400 Flémalle (“Givenmine”), act in this regard as separate managers for the processing of this data. DPHI SRL acts in this regard as a subcontractor for the processing of this data. Gesmall will process this data for the management and operation of the loyalty program and the implementation of targeted advertising and communication programs for Médiacité. Givenmine may use this data to conduct advertising actions only for the brands and stores at Médiacité or products sold at Médiacité.
The member understands that the processing of personal data for the management and operation of the loyalty program is done within a contractual framework, i.e. to respond to your request and perform this service. With regard to processing for targeted advertising and communication programs (as well as for advertising actions), the member accepts that their personal data may be used for such purposes. 
In accordance with Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR") and the Belgian laws transposing the GDPR, members can at any time obtain free access to personal data concerning them and obtain the rectification of any data that is inaccurate, incomplete or irrelevant. This data will be kept for a maximum period of five years, except in the event of the withdrawal of the member's consent, in which case such data must be immediately deleted. Members can request the rectification or request the deletion of their personal data upon simple request to info@mediacite.be. Members also have the right to lodge a complaint with the Belgian Data Protection Authority (https://autoriteprotectiondonnees.be/citoyen)
For the use of the personal data by Givenmine and the enforcement of the rights of access, rectification and/or deletion in relation to use by Givenmine, the managers refer members to the Givenmine privacy statement.

GENERAL TERMS AND CONDITIONS OF USE OF THE MEDIACITY LOYALTY PROGRAM

1.    Purpose
The loyalty program of the Médiacité application belongs to the company operating in the communication and marketing field, Givenmine SRL, registered with the Crossroads Bank for Enterprises under number 0744.638.712 whose registered office is located at Place Emile Vinck 1/7 at 4400 Flémalle. 
The daily management of the Médiacité application loyalty program is monitored by the management company of the Médiacité shopping centre, Gesmall, registered with the Crossroads Bank for Enterprises under number 0898.224.057, whose registered office is located at Rue de la Bonté 5 at 1000 Brussels. 
Givenmine SRL and Gesmall are hereinafter referred to as “the managers".
This loyalty program is only accessible to members registered with the Médiacité application. This multi-brand program is valid in all the stores at the Médiacité Shopping Liège shopping centre, with the exception of stores that cannot provide the correct equipment for the proper use of the loyalty program. Membership in the loyalty program by registering through the Médiacité application allows members to accumulate points to be exchanged for gifts, vouchers, exclusive advantages, etc.
2.    Acceptance of the general terms and conditions of use
The member acknowledges having read and accepted the general terms and conditions of use of the loyalty program as well as those of the Médiacité application and the privacy protection policy. The general terms and conditions of use of the Médiacité application are available at www.mediacite.be/cgu-application.
3.    The operation of the loyalty program

3.1.    Receipt scanning

3.1.1.    Loyalty points must be earned and accumulated according to the following process:
a.    Personal purchase in a store in the Médiacité Shopping Liège shopping centre.
b.    Recording of the purchase receipt (not the Bancontact ticket) using the scanning tab of the application with a photo of the receipt.
3.1.2.    The photo of the receipt must:
a.    Be legible.
b.    Not be blurry.
c.    Contain all of the information relating to the transaction and its location.
d.    Match a receipt from a store present at Médiacité that is not dated before 1/09/2020. 
e.    Not have already been entered into the loyalty program. It can therefore be scanned only once by a single user, all users combined.
3.1.3.    After recording the receipt, the receipts are processed as follows: 
a.    Granting of the loyalty points if the receipt complies with the rules described in points 3.1.1. and 3.1.2.
b.    No granting of loyalty points if the receipt does not comply with the rules described in points 3.1. and 3.2.
Points are accumulated as follows:
-    € 1 spent = 6 loyalty points,
-    1,500 loyalty points = 1 token to exchange for an advantage.
In case of an amount with decimals, the amount will be multiplied by 6 and then rounded down. Example: € 1.60 spent = 1.60 x 6 points = 9.6 = 9 points
3.2.    Tokens.
A new virtual token is awarded every 1,500 points. Virtual tokens can be exchanged at the info desk according to the procedure announced in the application in exchange for:
-    A day of parking.
-    A dealer of the month offer. The offer/promotion can be viewed from the application or on the Médiacité website at www.mediacite.be. It is only possible to take advantage of the current offer at the time that the token is redeemed. Each offer is valid on the dates mentioned and announced on the Médiacité website or on the offer in question. 
Promotional campaigns can be organised allowing the accumulation of one or more additional tokens. These campaigns can be subject to different promotional codes. However, the member can only use one code per campaign. 
The token exchange can be done at any time during the opening hours of the centre that can be viewed at www.mediacite.be. 
3.3.    Milestones.
By accumulating points, the member can reach milestones (Bronze Nugget, Bronze Bar, Silver Nugget, Silver Bar, Gold Nugget, Gold Bar, Platinum Nugget, Platinum Bar).
Some of these levels offer the possibility of participating in competitions: 
-    Silver Bar = 3,000 loyalty points = access to the monthly competition to win a Médiacité gift card worth € 150, valid for one year after the closing date of the competition.
-    Gold Bar = 15,000 loyalty points = access to the monthly competition to win a € 250 Médiacité gift card valid for one year after the closing date of the competition.
-    Platinum Bar = 30,000 loyalty points = access to the annual competition to win a trip to Disneyland Resort Paris worth € 1,500, excluding VAT.

3.4.    Determination of contest winners, winnings and withdrawals. 
The monthly contests take place every month between the 21st day of the month at 00:00 a.m. and the 20th day of the following month at 11:59 p.m. This period of time is referred to as a "period" in these rules. 
The annual competition takes place every year between October 21 at 00:00 a.m. and October 20 of the following year at 11:59 p.m.
As soon as a milestone is reached, the member has the opportunity to play the unblocked contest once per period. If the member reaches the next higher level, the member can then play once per period per contest for all of the milestones already reached.
A subsidiary question is asked each period for each competition. Over the same period, the member can answer the question for the same competition several times, but in this case, only the member’s last answer will be taken into account. The winners of the various contests are those who come closest to the correct answer. There is one winner per month for the monthly contests and one winner per year for the annual contest. In the event of a tie, the one who gave the answer first will be the winner.
The member is informed of the possibility of participating in the contests thanks to promotions, notifications or "push" messages from the application.
The winners of the various competitions will be informed by email of the procedure to be followed to claim their prize. On site, the Médiacité gift card of € 150 and/or € 250, valid for one year, will be given to them. In the event of a win in the annual competition, the trip will be organised according to the winner's wishes for a total amount of € 1,500, excluding VAT.
The list of gifts and contests may be modified at any time and for any reason by Gesmall without the member being able to exercise any recourse whatsoever against it. The list of the gifts, winnings and contests are available on the Médiacité application. This list is informative and can be modified by Gesmall at any time. Each gift, prize or competition is subject to the specific terms and conditions of acceptance of each brand. These gifts are not refundable in cash or by transfer or exchangeable. 
Each year, as of October 21 at 00:00 and from 2021, new objectives are to be reached for the member. This may possibly include resetting the points back to 0.  
4.    Reserved rights
The managers reserve the right to not award points in the event of non-compliance with the instructions, in the event of a duplicate or a suspected fraud attempt. Each receipt can only be scanned only once. 
Any abuse or non-compliance with these general terms and conditions or the terms and conditions of participation in the loyalty program will result in the exclusion of the member without the possibility of being able to re-register.
The managers reserve the right to modify, suspend or delete this loyalty program or any of its components without the right of recourse by the members or merchants.
5.    Responsibility
Participation in the loyalty program does not entitle the member to any other commercial advantage not specified in the application. In particular, Gesmall can in no way be held responsible for the modification of offers by the Médiacité merchants or for the closure of a brand. Gesmall may interrupt, suspend, modify or cancel the loyalty program without this entitling the member to any right of recourse. The member waives any recourse whatsoever for direct or indirect consequences arising from possible malfunctions or the termination of the program. In particular, the member acknowledges that the points accumulated by the member have no commercial value and that under no circumstances may the member request any compensation whatsoever due to the fact that the member could not proceed with the exchange of these points for whatever reason.
6.    Respect for privacy and personal data
The data collected as part of the Médiacité loyalty program can be qualified, in part, as personal data. They are stored by Givenmine SRL in one or more databases using a cloud service. Gesmall and its affiliated companies have access to the data in order to analyse such data with the assistance of its usual service providers for statistical purposes and to personalise its communication and advertising actions, by advertising on, in particular but not exclusively, Facebook and Google as well as by sending personalised communications for the attention of its customers. Givenmine, for its part, will only use the data collected in order to conduct advertising actions for brands and stores present at the shopping centre and cumulatively for the products sold at the shopping centre. Gesmall and Givenmine therefore act as separate data processors. The data relating to the receipts themselves will be destroyed after processing. Other data will be kept for a maximum of 5 years except in the event of the withdrawal of the member's consent, in which case such data must be immediately deleted.
